Rental Procedures

  Traverse City is now requiring a Vacation Home Rental License for any dwelling that is rented for a period of less than 30 days.  Our condo documents require that all co-owners comply with the law so we are asking that those of you who rent your unit for less than 30 days provide a copy of your license to Schmidt-Rogers Management, our management company.  You can obtain more information about the Traverse City requirements and an application at: http://www.traversecitymi.gov/downloads/vacation_home_application.pdf  

     To make it easier for owners to communicate important and crucial rules to their rental guests, we have enclosed a list of shortened rules taken from the Handbook. There is also a rental agreement form that must be filled out and signed by all owners engaging in rentals of any length. This can be found under the "Forms" tab.  Even though we have all agreed to abide by these rules when purchasing our units, we want to emphasize the specific rules that may not be understood by rental guests and have a signed form that owners are responsible for their guests understanding and abiding by our association rules. The form also requires updated phone numbers of owners so that in the case of rental guests not following our set rules, owners and/or their managment companies can be contacted directly by residents or by our management company.

     Along with these efforts to smooth out the experience of residents and rental guests, we encourage all Mercato residents to maintain a friendly residential environment here in the Mercato. Please try to engage with rental guests in a friendly, neighborly and inclusive way as we think this will help all guests understand that this is a community…not a hotel.

RULES

  1. No pets in any rental of less than 6 months
  2. No smoking anywhere in the building, units, balconies, or within 15 feet of the building and steps. "Smoking" shall include the inhaling, exhaling, burning, or carrying of any lighted cigarette, cigar or other tobacco product, marijuana, vaping, or illegal substance."
  3. Grills are not allowed in short term rental units.
  4. Quiet Hours: 9pm-8am – Including balconies and hallways.
  5. Noise should remain at levels considerate of neighbors next to, above, and below the source at all times.
  6. Trash/garbage: Owners and renters are required to remove all trash/garbage to the outdoor containers or dumpsters located near the Trash shall not be placed in the hallways or laundry rooms. Recycle bins are located in the laundry rooms for your convenience.
  7. No parties or events that may create a noise disturbance or nuisance.
  8. Parking: Only one temporary parking permit per rental, per stay. This parking pass allows the guest to park in any of the Mercado parking lots. Any additional cars can be parked further from the building.
  9. Do not share elevator code with anyone not staying in the unit. Visitors and food delivery must be met downstairs.
  10. Limit rental guests to 2 adults per bedroom plus 2 additional people.
  11. Bikes and baby strollers and other personal belongings are prohibited from the residential hallways and porches. Shoes, boots, skis, or snowshoes must be placed on a non-permeable mat or tray capable of collecting water and debris.
  12. Clearly post rental rules in condo for guests including all emergency and non-emergency numbers. Example:

COMPLIANCE/ENFORCEMENT

     Residents experiencing issues with rental guests may contact the owner of the unit or contact the management company. If it is a small issue, please contact the owner directly. Minor issues, if corrected promptly, may avoid a formal complaint. If it is a more serious violation (violation of especially the no smoking or no pets rule), please contact the management company, as this will likely be filed as a “formal complaint”.

     If an owner has had three formal complaints within 12 months, the owner will be notified by the management company and be “on probation”. If there are additional complaints when an owner is on probation, there will be a hearing set with the appropriate Committee who can then pass on a recommendation to the Board of Directors to revoke the owners option to offer rentals if the owner has been consistently unable to keep their guests compliant with Mercato rules.
